The Services are powered by Shopify, Inc., which provides our e-commerce platform.

Eligibility & Account Responsibilities

By using the Services, you represent that:

  • You are at least the age of majority in your jurisdiction;
  • Any minors using the Services do so with your permission;
  • The information you provide (email, shipping details, billing information) is accurate and complete.

You are responsible for safeguarding your account credentials. We may suspend or terminate any account that violates these Terms or is involved in suspicious activity.

Our Products

We make reasonable efforts to display products accurately, including colors and details. However, due to device settings and lighting, products may appear slightly different in person.

We do not guarantee that any product will meet your personal expectations. Product descriptions, availability, and pricing may change at any time.

We reserve the right to limit quantities, discontinue products, or restrict sales to certain regions or customers at our discretion.

Orders & Acceptance

Placing an order constitutes an offer to purchase. We may accept or decline your order at our sole discretion. An order is considered accepted only when we send an order confirmation email.

We may cancel or modify orders for reasons including:

  • Product unavailability;
  • Pricing or description errors;
  • Suspected fraud or resale activity;
  • Issues verifying payment information.

No Resale or Commercial Export

Products purchased from THE KRIPT are intended for personal use only. We may cancel orders that appear to be placed by dealers, distributors, or bulk purchasers.

Prices, Taxes & Billing

Prices may change without notice. The price charged will be the price shown at checkout at the time of purchase. Unless stated otherwise, prices do not include taxes, duties, tariffs, brokerage fees, or international import fees.

By submitting payment, you represent that:

  • Your payment information is accurate and authorized;
  • Your payment provider will honor the charges;
  • You agree to pay all amounts shown at checkout, including shipping and applicable taxes.

Orders may be subject to fraud screening. We reserve the right to cancel orders that cannot be verified.

Shipping, Delivery & Customs

Shipping methods, costs, and estimated delivery times are displayed at checkout. All delivery times are estimates only and are not guaranteed.

Once your order is transferred to the carrier, title and risk of loss pass to you. We are not responsible for:

  • Carrier delays or errors;
  • Packages marked "delivered" but not received;
  • Customs delays or holds;
  • Incorrect shipping details provided by the customer.

Customs Duties, Taxes & Import Fees

For orders where duties and taxes are not explicitly included at checkout, international customers are responsible for all customs duties, taxes, import fees, and brokerage charges upon delivery.

These charges are non-refundable unless required by local law (e.g., certain UK/EU statutory rights). If you refuse to pay customs charges and your order is returned to us, return shipping costs will be deducted from your refund.

Intellectual Property

All content on the Services — including text, images, logos, graphics, video, and design — is owned by THE KRIPT or its licensors and is protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any content without our prior written permission.

Third-Party Tools & Links

We may offer third-party tools or links as part of the Services. These are provided "as is" without warranty of any kind. We are not responsible for the accuracy, functionality, or content of third-party websites or tools.

Your use of any third-party services is entirely at your own risk.

Relationship with Shopify

The Services operate on Shopify's commerce platform. All transactions and customer interactions are solely between you and THE KRIPT.

You release Shopify, Inc. from any claims related to your purchases or use of the Services.

Feedback & User Content

By submitting reviews, photos, suggestions, or other content ("Feedback"), you grant THE KRIPT a worldwide, perpetual, royalty-free license to use, publish, modify, and distribute such content in any medium.

You warrant that you own or have the rights to any Feedback you submit and that it does not violate any third-party rights.

Errors & Omissions

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed. Orders affected by such errors may be cancelled or updated accordingly.

Prohibited Uses

You may use the Services only for lawful purposes. The following activities are strictly prohibited:

  • Fraud or unauthorized transactions;
  • Harassment or abuse of customers or staff;
  • Uploading malware or malicious code;
  • Scraping, crawling, or harvesting data without permission;
  • Any interference with the security or normal operation of the Services.

Returns, Refunds & Final Sale

All returns are handled in accordance with our Return & Refund Policy. The following rules apply across all orders:

  • Returns must be initiated within 14 days of delivery;
  • Items must be unworn, unused, with tags attached, and in original packaging;
  • Final Sale items are non-returnable for customers outside the UK/EU;
  • For UK/EU customers, Final Sale clothing may be returned under statutory cooling-off laws, except for underwear, swimwear, bodysuits, and items with broken hygiene seals;
  • Duties, tariffs, and taxes are non-refundable unless required by local law.
Shipping costs and package protection fees (e.g., Checkout+) are non-refundable under all circumstances.

United Kingdom — Consumer Rights

Customers in the United Kingdom have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

14-Day Statutory Cancellation

You may cancel your order within 14 days of delivery for any reason by notifying us clearly by email. Upon a valid cancellation, you will receive a refund of:

  • The price paid for the goods;
  • The cheapest standard delivery cost available at checkout.

You are responsible for the cost of return shipping unless the item is defective.

Items Excluded from UK Cancellation Rights

  • Underwear, swimwear, bodysuits, and hygiene-sensitive items once unsealed;
  • Custom or personalized items;
  • Goods inseparably mixed with other items after delivery.
Nothing in these Terms affects your statutory rights under UK consumer law. In the event of any conflict between these Terms and your statutory rights, your statutory rights will prevail.

European Union — Consumer Rights

If your order is delivered to the European Union, you have a 14-day cooling-off period under EU consumer law. Upon a valid cancellation, you will receive a refund of:

  • The product price;
  • The cheapest standard shipping cost available at checkout.

You are responsible for return shipping costs unless the product is defective. Duties and taxes are refunded only where required by local law.

Nothing in these Terms limits or excludes any rights you have under mandatory EU consumer protection laws in your country of residence.

Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, labor disputes, shipping disruptions, pandemics, or governmental actions.

Disclaimer of Warranties

The Services and all products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or that products will meet your personal expectations.

For UK and EU customers, this disclaimer applies only to the extent permitted by mandatory consumer protection laws in your jurisdiction.

Limitation of Liability

To the fullest extent permitted by law, THE KRIPT is not liable for any indirect, incidental, or consequential damages, including lost profits or data loss, arising from your use of the Services or purchase of our products.

Our total liability to you shall not exceed the amount you paid for the product giving rise to the claim.

For UK and EU customers, we do not exclude or limit liability for death, personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Arbitration & Class Action Waiver

This section applies only to customers outside the UK and EU.

Any dispute arising from these Terms or your use of the Services shall be resolved through binding individual arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration.

UK and EU customers retain their statutory rights to bring claims before their local courts and are not subject to this arbitration clause.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

UK and EU customers may rely on the mandatory consumer protection laws of their country of residence, which may provide additional or different rights that cannot be waived by contract.

Updates to These Terms

We may update these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
